1. Acceptance of Terms

By accessing or using WHOSENXT ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services.

2. Eligibility

• You must be at least 16 years old to create an account
• Users under 18 may have restricted access to certain features
• Business and driver applicants must be at least 18 years old and provide valid identification

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate, current, and complete information. You must not share your account or use another user's account without permission.

4. Marketplace & Transactions

• WHOSENXT acts as a platform connecting buyers and sellers; we are not a party to individual transactions
• Sellers are responsible for the accuracy of their listings and the quality of goods/services
• All payments are processed securely through Stripe
• Commission rates vary by subscription tier and merchant plan
• Escrow payments for gig work are held until work is approved or a dispute is resolved

5. Gig Economy Services

Workers and gig posters are independent parties. WHOSENXT provides the platform but does not employ, supervise, or control the work performed. Escrow protections are available to secure payments for both parties.

6. Delivery Services

Listed businesses are independent entities and are not affiliated with, endorsed by, or partnered with WHOSENXT unless explicitly stated. Delivery drivers are independent contractors. WHOSENXT facilitates delivery logistics but is not responsible for the quality or timeliness of food preparation.

7. Subscriptions & Billing

• Subscription plans are billed monthly or annually as indicated at checkout
• You may cancel your subscription at any time through the customer portal
• Refunds for subscriptions are subject to our Refund Policy
• Merchant plans have separate terms regarding commission rates and features

8. Community Standards

All users must adhere to our Community Guidelines. Violations may result in content removal, account suspension, or permanent banning. Content moderation is enforced both automatically and by our team.

9. Intellectual Property

The WHOSENXT name, logo, and platform design are our intellectual property. Users retain ownership of content they post but grant WHOSENXT a non-exclusive license to display it on the platform.

10. Limitation of Liability

WHOSENXT is provided "as is" without warranties of any kind. We are not liable for disputes between users, losses from transactions, service interruptions, or third-party actions. Our total liability shall not exceed the amount you paid to us in the preceding 12 months.

11. Termination

We reserve the right to suspend or terminate accounts that violate these terms. You may delete your account at any time through Account Settings.

12. Changes to Terms

We may modify these terms at any time. Continued use of the platform after changes constitutes acceptance of the new terms.
